Definitions:

AHW – Alpine Home Warranty, LLC

Home, Building, Property – Structure located at address recorded on contract

Provider – Alpine Home Warranty, LLC

Seller – Person, or entity, selling the property.

Homeowner – Service Contract Holder

Problem or Malfunction – Mechanical failure of an appliance or component to perform its intended function(s)

Non-Manufacturer’s Parts – Replacement parts not made for, or by, original manufacturer of the goods; commonly referred to as “after-market parts”

  1. How to Make a Claim

   To report a problem or malfunction please call 801-571-0344. Once coverage is verified, AHW will contact a qualified contractor. The contractor will contact the Homeowner to schedule a convenient appointment time. Homeowner is responsible for any overtime charges as a result of after-hours services for non-emergency repairs. Emergency services are for malfunctioning furnaces, water heaters, leaks or breaks in interior water, gas and sewer lines and sewer back ups. If a problem reported as an emergency is determined not to be of an emergent nature, homeowner will be responsible for additional costs incurred for emergency response. Standard business hours are Monday through Friday, from 9:00 AM to 5:00 PM. You may reach our emergency answering service outside of normal business hours by calling our office number at 801-571-0344.

  1. Transferring of Contract

   If the covered property is sold within the 2 to 5-year time period, it is the seller’s responsibility to contact AHW with the new owner’s information. Failure to do so eliminates any responsibility for the new homeowner by AHW.

  1. Cancellation

   The home warranty contract is noncancellable for the term specified. AHW reserves the right to cancel a contract as a result of fraud, misrepresentations or failure of the homeowner to pay deductible fees, or for services rendered outside the contract.

  1. Approval and Conditions

   AHW will not reimburse homeowners for services performed without pre-approval or authorization. AHW contracts with specific contractors and vendors that must provide services according to this contract and its conditions. AHW reserves the right to decide which contractor or vendor will perform service. Homeowners are not authorized to make any commitments on AHWs behalf with the service contractor. Any charges not specifically authorized by AHW will be the homeowner’s responsibility. Coverage is only provided within the terms of this contract, which is for a 4 year period unless coverage is extended and paid for. The contract only covers the items and systems indicated in this agreement; any and all others that are not mentioned are excluded from the contract. Covered items must be in good working condition at the beginning of the contract and items not working will not be covered.

  1. Payment, Service Fee, Agreement

   Upon payment of full contract fee, AHW will repair, or replace, malfunctioning items that are covered during the term of this contract. In order for the item(s) to be repaired or replaced, claims must be pre-approved by AHW. There is a $60.00 deductible fee required on each claim item, to be paid at the time of service. Failure to pay the required deductible fee(s) will result in coverage being suspended until all charges are paid. No new claims will be approved during this time. Once payment is received, coverage will be reinstated for the remainder of the contract period. No extensions will be granted due non-payment of charges. Out of area charges of $25 may apply for some services.

  1. Utah Residents

   The coverage afforded under this contract is not guaranteed by the Property and Casualty Guaranty Association. Customer will all the use of non-manufacturer’s parts as long as procedure complies with applicable state and federal laws. Non-manufacturer’s parts may be used when manufacturer’s parts are not available, or when they can offer the same performance and functions as the manufacturer’s parts.

  1. Limits of Liability
  • If contract applies to multi-unit dwelling, condominium, or mobile home, AHW shall be obligated only with respect to repairs or replacement which can be performed within the confines of the units covered by this contract. AHW shall not be held liable for repairs or replacements for common areas or facilities of condominiums or mobile home parks. AHW shall only be responsible for repairs or replacements within the walls of the covered units covered by this contract.
  • Repairs or replacement of items caused by the following are not covered: Fire, flood, smoke, pest damage, acts of God, lightning, earthquake, freezing, theft, storms,  accidents, mud, war, riots, improper installation i.e.: missing parts, incorrect installation, manufacturer’s defects, modified or replaced outside of manufacturer’s specifications, misuse, abuse, vandalism, neglect, water damage, lack of capacity, structural changes, electrical failure, shortage, surge or overload, pet damage, cosmetic defects or design flaws. Items covered by manufacturer, distributer, builder or an extended warranty. Repairs or replacement required as a result of improper previous or attempted repair by homeowner.
  • AHW reserves the right to a second opinion at no extra charge to the homeowner.
  • AHW reserves the right to have a component or part rebuilt, or to replace part or component with a rebuilt or refurbished part or component.
  • AHW will not replace, refinish, or alter cabinets, countertops, tile, or flooring.
  • This contract covers single-family residential properties that are less than 5,000 square feet, unless approved by AHW. Homes over 5,000 square feet are covered if approved by AHW and additional fees are paid. Contract coverage is for residential use only, commercial property is excluded.
  • AHW will determine whether a covered item will be repaired or replaced. Systems or appliances will be replaced with equipment with similar features, efficiencies and capacities. AHW is not responsible for matching color, brand, or size to accommodate limited spaces. AHW reserves the right to provide cash in lieu of repair or replacement in the amount of our actual cost. Payment will be based on negotiated rates with Alpine contractors; in some cases, this may be less than retail cost. Once cash in lieu is provided, AHW is no longer responsible for repair or replacement of the item(s) for the duration of the contract.
  • AHW is liable for covered items due to normal wear and tear. Inadequate performance of an item or appliance outside of mechanical malfunction i.e.: hard water, off brand detergents, energy saving devices, filtration or other systems added by the homeowner, will not be covered.  Cosmetic damage is not covered.
  • AHW is not liable for consequential or secondary damage that may occur as a result of an item or system failure.
  • The homeowner is responsible for any corrections, repairs, replacements, upgrades, or any extra costs related to complying with federal, state or local laws, utility regulations, building codes or zoning.
  • AHW will not affect service that involves toxic or hazardous materials including asbestos or any other contaminants that may be found. AHW will not be held liable for any claim arising out of any pathogenic organism regardless of any event or cause that contributed in any sequence to damage or injury. These pathogenic organisms are bacteria, yeasts, mildew, fungi, virus, mold, mold spores, mycotoxins or other metabolic products.
  • AHW will not be responsible for costs associated with, or from, manufacturer’s recall of any covered item, manufacturer’s defects, or any items that carry a manufacturer’s warranty that is currently valid. AHW will not be responsible for repair or replacement of items or systems deemed defective by the Consumer Product Safety Commission.
  • AHW will not be liable for collapsed piping, light bulbs, filters, pulleys, belts, bolts, nuts, wood, burglar and fire alarms, electronic or computerized system management controls or terminals.
  • AHW is not responsible for any items outside the foundation of the home. These items include sprinkler systems, outside sewer lines, power lines, gas lines, underground wiring and roofing.
  • Problems caused by rust or corrosion during the first 45 days of the contract period are excluded. If a claim is made on such an issue, AHW will not cover that item unless, or until, documents are provided by a licensed contractor stating the specific issue was repaired.
  • Homeowners are responsible for proper maintenance and cleaning of covered items and systems. Ex.: routine furnace filter replacement, winterization of evaporative coolers and keeping appliances free of dust, dirt and debris. Routine maintenance and repairs necessitated by failure to perform routine cleaning that is specified by the manufacturer will not be covered by AHW.
  • AHW will not be responsible for permit fees, haul away and disposal fees. Construction, or any other fees made necessary by homeowner making changes to the dwelling. Homeowners are responsible for the removal of defective systems and appliances.
  • AHW will not be responsible for costs or expenses in excess of $2,000 per service request (this includes cost of equipment, diagnosis, labor costs, and materials). AHW will not be responsible for any amount in excess of $10,000 aggregate under this contract.
  • AHW provides coverage for unknown conditions if the condition would not have been detectable by the seller, potential buyer, or real estate agent through a visual inspection, or simple mechanical inspection. This inspection will generally be provided by a home inspection professional. Mechanical items such as furnaces, water heaters, air conditioners and appliances should be operational and in good working condition at the time of purchase.
  • At times it is necessary to open walls, floors or ceilings to perform a service. AHW does not repair or replace materials removed to perform warranty covered services.
  1. Standard Coverage

   The following items are covered by this contract. Items “not covered” have also been added to assist the homeowner.

  • Interior Plumbing System
  1. Leaks and breaks in water, vent, drain and gas lines.
  2. Valves: shower, tub, faucets and diverters. Replaced with builder’s standard; maximum $100.
  3. Toilets: tanks, bowls and interior mechanisms. Replaced with builder’s standard; white.
  4. Permanent sump pumps located within the perimeter of the foundation.
  5. AHW will pay a maximum of $1,000 per contract for the diagnosis, access, repair or replacement for heating systems that utilize steam, heated water, glycol or electric baseboard.

Not Covered: Concrete covered or encased items, fixtures, shower enclosures, freezing, tile, water purification (odor, taste and color), filters, shower head, base pans, shower doors, shower arm, caulking, grouting, saunas and steam rooms, septic tanks, hose bibs, corrosion, rust, jets on a whirlpool, fire suppression systems, pressure regulators, mineral deposits, angle stop and gate valves, water pressure problems, water conditioning equipment, cross connections and any parts added by homeowner after effective date of the contract.

  • Plumbing Stoppages
  1. The clearing of stoppages in the drain, vent and sewer lines up to 100 feet of point of access where ground level cleanout exists.
  2. AHW is only responsible for one sewer stoppage clearing per each separate main sewer line, secondary waste line, or toilet.

Not Covered: Stoppages that are caused by roots or collapsed sewer lines outside of the foundation, stoppages that cannot be cleared by a cable, inadequate or excessive water pressure or flow restrictions. AHW will not be responsible for access to drain or sewer lines from vents or removal of a toilet, the removal of water closest, costs associated with locating the problem, costs to access or install a ground level cleanout and any back flow damage, damage caused by roots or collapsed sewer lines outside the foundation.

  • Water Heater
  1. Gas or electric water heater up to 40 gallons in capacity.
  2. AHW will pay up to $1,500 maximum per contract for diagnosis, access and repair or replacement of any glycol, hot water, steam circulating, electric baseboard, or boiler/water heater system.
  3. Heating element, pressure relief valve, thermostat and drain valve.

Not Covered: Sounds and smells caused by sediment build up, expansion tanks, holding and storage tanks, flues and vents, solar equipment, any items not mentioned and any items added after the effective date of this contract.

  • Heating System
  1. Gas, oil or electric heating systems.
  2. Burner, heat exchanger, blower, blower motor, gas valve. Programmable thermostat (up to $100 less service fee).
  3. AHW will pay up to $1,500 maximum per contract for diagnosis, access and repair or replacement of any glycol, hot water, steam circulating, electric baseboard, or boiler/water heater system.
  4. The homeowner is responsible to perform proper maintenance and have furnaces serviced as needed. The homeowner is also responsible to have operable CO2 and Smoke detectors in the home in the event of an emergency.

Not Covered: Concrete covered or encased items, registers, grills, insulation, fireplaces (gas, log and corn fueled), space heaters, filters, fuel tanks (oil or gas), humidifiers, heat lamps, electronic air cleaners, solar heating systems, flues and vents, piping for geothermal or water source heat pumps, well pumps for geothermal uses, cable heat and wood stoves and any parts added by homeowner after effective date of contract.

  • Air Conditioning
  1. Compressor, condensing coils, blower, condenser unit, heat pump, valves, breakers, disconnect box, wiring.
  2. Electric forced air conditioning system or primary electric evaporative cooler unit, primary wall air conditioning unit and heat pumps.
  3. AHW will pay a maximum of $1,500 per contract for diagnosis, access and repair or replacement of air conditioning systems.

Not Covered: Parts and components for gas air conditioning systems (except those using freon) Freon, Freon evacuation, freon recovery, freon leaks, electrostatic air cleaners, registers, insulations on hoses, filters, window or portable air conditioning units, grills, underground or outside lines and components for geothermal and/or water conditioning systems, items imbedded in concrete, roof damage related to repairs to roof mounted units, any parts not mentioned in this contract and any parts added by the homeowner after effective date of contract.

  • Interior Electrical System
  1. Interior wiring, electrical boxes, fuse/breaker panels, switches, receptacles, exhaust fans.

Not Covered: Bathroom heaters, alarm systems, intercom systems, in home sound and theater systems, wiring outside of the home, problems with code violations, concrete covered or encased electrical wiring, light fixtures, fans (includes ceiling, attic and paddle fans), improper wire size, resolving double-tapping, service entrance wires to covered structure, telephone system wiring, doorbells, power failure or surges, low voltage, underground wiring, any other wiring not mentioned in the contract and any parts added by the homeowner after effective date of contract.

  • Kitchen Appliances
  1. Built-in Dishwasher: all parts covered except the following. Not Covered: racks, trays, rollers, baskets, knobs, diminished cleaning or other issues due to hard water, hard water build up, clearing debris from drain strainer, failure to clean and maintain appliance and other cosmetic problems.Maximum liability of $1,000, less deductible.
  2. Built-in Microwave Oven: all parts covered except the following. Not Covered: Turn-table system, knobs, racks, door glass, handles, interior lights. Timers and docks are covered to a maximum of $100 less deductible.Maximum liability of $1,000, less deductible.
  3. Oven/Range/Cooktop: all parts covered except the following. Not Covered: knobs, dials, racks, lights, door glass, handles, interior lining, buttons, self-cleaning systems. Timers and docks are covered to a maximum $100 less deductible. Single oven coverage only unless otherwise approved by AHW and additional fees are paid. Maximum liability of $1,000, less deductible.
  4. Garbage Disposal: all parts and components. Not Covered: Service required due to foreign objects, such as glass or metal, inside the disposer will not be covered.
  5. Trash Compactor: all parts covered except the following. Not Covered: knobs, removable baskets, locking mechanism.
  6. Refrigerator: All parts and components covered except for the following.

Not Covered: insulation, racks, ice maker, shelves, handles, ice crusher, rollers and brackets, water dispenser, baskets, knobs, Freon, Freon evacuation, Freon recovery, Freon leaks, refrigerators and freezers that require an additional compressor to function. Maximum liability of $1,000, less deductible.

  • Garage Door Opener
  1. Motor only

Not Covered: Garage door, door opener, springs, hinges, motion sensors, transmitters, door adjustments, tracks, doors without safety return devise, any items added by homeowner after effective date of contract.

  • Roof
  1. Leaks Only, $1,000 aggregate per contract.

Not Covered: Porches, Patios, Decks, Metal Roofs, missing or broken shingles, tiles, asphalt, flashing, attic vents, skylights, or if the roof has deteriorated so severely that it cannot be repaired or needs to be replaced. Gutters, drains, leaks involving roof mounted installations, ice dam build-up, deck or balcony roofs, wood and underlayments, counter flashing, leaks resulting from or caused by any one of the following: acts of God, damages to persons, walking or standing on roof, incorrect repairs made by others, failure to perform normal maintenance.
